Basic Guide to Overtime (Farm Workers)

Maximum overtime hours permitted and the pay for such hours.

Application

Sectoral Determination 8: Farm Worker Sector applies to all workers on a farm including

• domestic workers, and
• security guards.

The sectoral determination does not apply to workers covered by -

• another sectoral determination; or
• a bargaining council agreement.

The Basic Conditions of Employment Act applies in respect of any matter not covered by this sectoral determination.

Basic conditions of employment for farm workers

Overtime Hours

Workers may not work –

• overtime, unless by agreement
• more than 15 hours’ overtime a week 
• more than 12 hours on any day

Pay for Overtime

• Employers must pay workers overtime at 1.5 times the normal wage.
• Alternatively, a worker may agree to receive paid time off.
• Any overtime worked on a Sunday or public holiday must be paid in accordance with the provisions for Sundays and public holidays.
